The Armed Forces Tribunal (AFT) was established under the Armed Forces Tribunal Act, 2007 to provide speedy justice to defence personnel in matters relating to service, pension and disciplinary proceedings. The Principal Bench is at New Delhi with Regional Benches across India.
Jurisdiction of the AFT
The AFT has jurisdiction over: service matters (promotions, postings, pay, seniority); pension disputes; court martial appeals; and disciplinary proceedings. Serving and retired personnel of the Army, Navy and Air Force can approach the AFT.
Filing an Application
An Original Application (OA) is filed before the AFT after exhausting the Statutory Complaint procedure. The application must be filed within three years of the cause of action. The AFT follows a simplified procedure and does not require technical pleadings.
Appeals
Orders of the AFT can be challenged before the Supreme Court of India under Article 136 of the Constitution.
